The tenant and the landlord together before the tenant moves into the property must inspect the property and assess the defects or damages to such property, if any, with a view to recording such defects or damages and with a view to determining the landlord’s responsibility to rectify them.
When the lease ends the landlord and the tenant must jointly inspect the property at a mutually convenient time, within three days of the ending of the lease, to determine if damage has been caused to the property while the tenant occupied the property.
If the landlord doesn’t conduct this inspection this will constitute an acknowledgement by the landlord that the property is in a good and proper state of repair – the full deposit must be refunded by the landlord to the tenant.
When the lease terminates, should the tenant not respond to the landlord’s request to inspect the premises, the landlord may inspect the premises himself to assess the damages and this must be done within seven days of the ending of the lease.
